Conditional Waiver and Release on Final Payment
Used at the end of the project with your final pay application. Waives all remaining lien rights — but only after that last payment clears. This is your protection against signing away rights on a final check that bounces.
Unconditional Waiver and Release on Final Payment
The last document on the project. Sign this after final payment has been received and cleared. It permanently waives all lien rights on the property — no conditions, no takebacks. Only sign once the money is in your account.

When you submit a pay application and receive payment, the GC or owner will ask for a signed waiver of lien form before releasing funds. It protects the property owner from double-payment claims down the chain.
What's the difference between conditional and unconditional lien waivers?

A conditional lien waiver only takes effect once payment actually clears. You're saying "I'll waive my lien rights for this amount, but only after the check clears." An unconditional lien waiver takes effect immediately when you sign it — whether or not you've been paid yet. Rule of thumb: use a conditional waiver when you're submitting your pay app and haven't received funds. Use an unconditional waiver after the money is in your account.

Do I need a specific lien waiver template for my state?

It depends on the state. About a dozen states — including California, Texas, Georgia, and Florida — have statutory lien waiver forms. That means the state legislature has mandated the exact language your waiver must use. If you use a generic template in a statutory state, it may not be enforceable, and you could lose your lien rights entirely.
