A lien waiver is a document where a claimant — contractor, subcontractor, or supplier — gives up their right to file a mechanics lien against a property. It's standard on every construction project. When you submit a pay application and receive payment, the GC or owner will ask for a signed waiver of lien form before releasing funds. It protects the property owner from double-payment claims down the chain.

What's the difference between conditional and unconditional lien waivers?

A conditional lien waiver only takes effect once payment actually clears. You're saying "I'll waive my lien rights for this amount, but only after the check clears." An unconditional lien waiver takes effect immediately when you sign it — whether or not you've been paid yet. Rule of thumb: use a conditional waiver when you're submitting your pay app and haven't received funds. Use an unconditional waiver after the money is in your account.

What are the four types of lien waivers?

There are four standard lien waiver forms used in construction: (1) Conditional Waiver and Release on Progress Payment — used with each pay application during the project, effective only when that payment clears. (2) Unconditional Waiver and Release on Progress Payment — signed after a progress payment has been received. (3) Conditional Waiver and Release on Final Payment — used with your final pay app, conditional on receiving the last check. (4) Unconditional Waiver and Release on Final Payment — signed after final payment clears, waiving all remaining lien rights on the project.

Do I need a specific lien waiver template for my state?

It depends on the state. About a dozen states — including California, Texas, Georgia, and Florida — have statutory lien waiver forms. That means the state legislature has mandated the exact language your waiver must use. If you use a generic template in a statutory state, it may not be enforceable, and you could lose your lien rights entirely.
