Lien Waiver FAQ

What is a lien waiver?

+

A lien waiver is a document where a claimant — contractor, subcontractor, or supplier — gives up their right to file a mechanics lien against a property. It's standard on every construction project. When you submit a pay application and receive payment, the GC or owner will ask for a signed waiver of lien form before releasing funds.

What's the difference between conditional and unconditional lien waivers?

+

A conditional lien waiver only takes effect once payment actually clears. You're saying "I'll waive my lien rights for this amount, but only after the check clears." An unconditional lien waiver takes effect immediately when you sign it — whether or not you've been paid yet. Use conditional when submitting your pay app; unconditional after the money is in your account.

What are the four types of lien waivers?

+

There are four standard forms: (1) Conditional Progress — used with each pay application, effective when payment clears. (2) Unconditional Progress — signed after a progress payment is received. (3) Conditional Final — used with your final pay app, conditional on last check. (4) Unconditional Final — signed after final payment clears, waiving all remaining lien rights.

Do I need a specific lien waiver template for my state?

+

About a dozen states — including California, Texas, Georgia, and Florida — have statutory lien waiver forms with mandated language. Using a generic template in a statutory state may not be enforceable. DocJoist handles this automatically — pick your state, and you get the right form.

Is this free lien waiver form legally compliant?

+

Yes. For statutory states, our lien waiver forms use verbatim language from the relevant statute. For non-statutory states, we use industry-standard legal language covering claimant identification, property description, through date, payment amount, and the waiver clause.

Do lien waivers need to be notarized?

+

Most states don't require notarization. A few — like Mississippi and Wyoming — do require it for certain waiver types. Our generator flags notarization requirements for your state automatically and includes the notary block on the PDF when required.
